APPROPRIATE USAGE POLICY - HOSTING

By owning a hosting or email account with kathi's virtual office @ cybersquaremall.com you agree to the following:

1.) kathi's virtual office reserves the right to refuse service to anyone for any reason whatsoever. We also reserve the right to cancel existing accounts without reason or warning.

 

2.) In the event of non-payment, any breach of this agreement or for any other reason within the sole discretion of kathi mcmanus and/or the staff comprising kathi's virtual office, kathi's virtual office shall have the right to immediately, without need for notice, terminate client's hosting or email account. In the event of an account cancellation, by kathi's virtual office or the customer, kathi's virtual office will not necessarily issue a refund.

3.) kathi's virtual office reserves the right to change fees, surcharges, or institute new fees at any time. Please note that if you pre-pay, you will be locked in for the pre-payment period. Though an invoice will be sent, it's the customer's responsibility to keep abreast of any rate changes or new hosting packages at http://www.cybersquaremall.com/hosting/ when renewal comes due.

4.) kathi's virtual office is not responsible for lost revenue, traffic, or data caused by server down time or failure. The internet is a living thing subjected to all the whims of nature and man and we can't be responsible for it. If you're having an issue please visit the tech department before contacting us.

5.) Customers of kathi's virtual office are forbidden to partake in an "abusive practice." We will be the sole arbiters as to what constitutes a violation of this provision.

The following is a list of current abusive practices. Participating in an abusive practice will lead to an immediate account termination without prior notice or refund on any pre-payment. kathi's virtual office reserves the right to add to or modify this list at any time:

--Sending "bulk e-mail" with your account. (aka "Spamming" or "UCE")
--Using your email address from your account to spam newsgroups.
--Uploading, posting or reproducing in any way materials protected by copyright without the permission of the copyright holder.
--Using your account to provide "counter or other cgi related services" to large quantities of people on the web. [UNLESS, you have pre-paid for this type of bandwidth in advance.]

6.) Customers of kathi's virtual office are held bound to all system policies not specifically listed within this agreement. {If something's illegal in general, it won't be covered here.}

7.) kathi's virtual office's hosting services may only be used for lawful purposes. Transmission of any material in violation of any U.S. or any State's regulation is prohibited. This includes but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. The client specifically agrees to indemnify and hold kathi's virtual office,   cybersquaremall.com,  and kathi mcmanus (and any persons associated with this company therein) harmless from any claims resulting from a breach of these terms, and/or their use of the service which damages another.

8.) This agreement constitutes the entire agreement between the parties hereto. The terms and conditions of this agreement shall be interpreted and enforced pursuant to the laws of the State of South Carolina.

9.) This agreement is not assignable or transferable.

10.) Any party seeking to report any violations of this policy may contact us via e-mail: {Forward UCE/spam messages with full headers intact.}

BILLING POLICY

Clients must abide by all the terms set forth in this billing policy as well as the appropriate usage policy.

Account Cancellations: In the event that the customer decides to terminate hosting services with kathi's virtual office an email letting us know to kill your account, would be greatly appreciated. [Of course, not paying is effective at getting this across, but then it prolongs our agony in having to email you notices and those embarrassing signs start going up...]  [Leave the subject line as is.]

Stopping Development Service: In the event that the customer decides or is ready to terminate the development of their website by kathi, please refer to the contract.

Billing, via email or postal or FAX, will be made at the first of the month and are due no later than the 15th. Hosting prices are subject to change in the future, but are guaranteed through your paid billing period. (If you pre-pay for a year, your price will remain throughout your billing period for the year, protecting you from an increase.)

* Payments not received by the 15th may subject your account to suspension: In this case a $50 reinstatement fee will accrue. If the entire amount due + $50 is not paid in total by the 1st of the next month, an additional 25% will also be due by the following 15th. Failing this, you will irrevocably lose the copyright and/or the hosting services, whichever this applies to. [These fees are not to be construed as punitive, but as compensation.]

Check, money order, credit card via Paypal, online check via PayPal is the only way we can take money at this time. Paper checks must be drawn on a US bank in US funds. Paying with check you acknowledge and accept a $25 charge on all returned checks.

*A pardoned extension is for clients who, under good payment history in the past, cannot get their payments in on time right now for whatever reason. As long as an email is sent before the 5th of the month your bill is due, explaining that you need an extension or would like to work out a payment arrangement, a 5% one time [non-penalty] fee to the total bill will be added and your account will remain live for an additional month. [So, by the next billing cycle, total+5% will be due in total.] 

PRIVACY POLICY

kathi's virtual office is committed to protecting your privacy online and any information collected is only used for internal purposes. We use the information that we do collect and that is voluntarily provided by the consumer to accurately deliver the requested information and is never given, sold, bartered, exchanged, or otherwise delivered or transmitted to any third party.

For each visitor to our Website, our Web server automatically recognizes information regarding the IP, domain or e-mail address. Unlawful use while on this server will be recognized. Otherwise your information will not be called into question or made known to a third party.

We collect aggregate information on what pages consumers access or visit and information volunteered by the consumer, such as ordering information and/or site registrations. The information we collect is used for internal review, used to improve the content of our Web page and not shared with other organizations for commercial purposes.

Any information you provide will be used only for informational, billing, or contact services. If you supply us with your postal address on-line you will only receive the information for which you provided us your address. Persons who supply us with their telephone numbers on-line may receive telephone contact from us with information regarding orders or requests for services they have placed on-line. You will not be solicited by any third party due to the information you have given us.

Links offsite from cybersquaremall.com may have their own privacy policy but under no circumstances can cybersquaremall.com be held responsible for their collected data, if any. Cookies are used at this site for aggregate purposes in determining marketing strategy only. You are not personally identifiable just by being here.

Please note that when signing up for a domain your name, address, phone phone, and all information you provide, within this context, may be accessed by a third non-related party. In this course and only in this manner will your private information be viewable. kathi's virtual office cannot be responsible for other domains activities in this manner except to assure you that all necessary precautions by kathi's virtual office will be taken in order to protect your privacy.

Please note that emails in direct relation to your hosting, email, internet development, site design, consultation, or billing must always have your accurate email address associated with it in order to communicate to you. Failure to have a working email address where Kathi can get in touch with you may result in downtime, loss of service, halted website design or generic service. Not out of penalty, but because email correspondence is the primary method of contact from the virtual office, for record-keeping.
